The Improving Teacher Quality Grant Programs (Title II) are a major component of the No Child Left Behind legislation. These programs encourage scientifically-based professional development as a means for improving student academic performance. As schools are responsible for improving student learning, it is essential to have highly qualified teachers leading the way. HYPERLINK "http://www.ed.gov/policy/elsec/leg/esea02/pg26.html"Title II, Part B of NCLB authorizes the HYPERLINK "http://www.ed-msp.net"Mathematics and Science Partnerships (MSP) program. MSP is intended to increase the academic achievement of students in mathematics and science by enhancing the content knowledge and teaching skills of classroom teachers. Partnerships between high-need school districts and the science, technology, engineering, and mathematics (STEM) faculty in institutions of higher education are at the core of these improvement efforts. Additional partners may include public charter schools, businesses, and nonprofit or for-profit organizations concerned with mathematics and science education. Private schools are encouraged to participate in the program. Private schools within the boundaries of any high-need Local Education Agency (LEA) may participate directly in the program through the local public school district. Other private schools may participate as a secondary partner with any high need LEA. Mathematics and Science Partnership program continuation grants will be awarded by the New Jersey Department of Education (NJDOE) to support programs designed to improve mathematics and science instruction. The Department of Education has established a three-year project using federal funds as follows: Year One, July 1, 2010 to June 30, 2011; Year Two, July 1, 2011 to June 30, 2012; and Year Three, July 1, 2012 to June 30, 2013. Year Three awards are contingent upon successful completion of Year One and Two program activities and upon adherence to all requirements. The eligible candidates for Year Three of this continuation grant are five of the Lead Agencies, and their partner local education agencies, that were competitively awarded funding in Year One. These eligible institutions of higher education are Montclair State University, Stevens Institute of Technology, Kean University, Middlesex County College, and Rowan University. MSP funds support the development of partnerships between IHEs and LEAs. Each organization is responsible for the success or failure of the project and therefore must demonstrate an active role. Proposals that demonstrate vendor-client relationships will not be funded. Funded professional development activities should focus on activities that support the revision of K-12 math and science curriculum and the development of teacher content knowledge. The content knowledge should be developed through the practice of identifying and clarifying core knowledge and skills in mathematics and science. The goals of each program should be that, as a result of the sustained supported professional development, participants will: Identify and clarify core knowledge and skills in mathematics and science that are aligned to the content foci for the program year. The clarifications should include core concepts, specific ideas, practices, level of sophistication, and appropriate technical terms related to a topic at specific grade levels embedded in the Common Core State Standards for Mathematics and the New Jersey Core Curriculum Content Standards for Science. Improve the coherency of the development of mathematical and scientific ideas from grades K to 12. Participants will make effective use of research on student learning to identify potential learning difficulties, developmental considerations, and common misconceptions associated with a science or mathematics topic. Apply effective content-specific pedagogical strategies and teach scientific and mathematical ideas by imbedding them in useful contexts. Develop their ability to make connections within and across mathematics and science topics. Be empowered to continue and expand the work of their professional learning communities once funding is no longer available. MSP Key Features Partnerships: MSP local projects are to be designed and implemented by partnerships that include IHE STEM faculty, K-12 administrators, faculty, and guidance counselors in participating K-12 schools, and administrators in higher education organizations. Additional partners are encouraged and may include businesses and additional departments of an institution of higher education (IHE). These partners and other stakeholders are to engage in the effort at both the institutional and individual levels, and share goals, responsibilities, and accountability for the project. The partnerships must include a mathematics, science, and/or engineering department at an IHE and current partner LEAs. Content-Based Professional Development: The projects are to focus on the revision of K-12 mathematics and science curriculum and on the development of teacher content knowledge. The content knowledge is to be developed through the practice of identifying and clarifying core knowledge and skills in mathematics and science as specified in the New Jersey Core Curriculum Content Standards for Science and in the Common Core State Standards for Mathematics. Needs Assessment: Projects must address the results of a comprehensive assessment of (a) the local board approved curriculum in math and science, and (b) the professional development needs of the mathematics and science teachers as identified by the schools and LEAs in the eligible partnership. Scientifically-Based Research (SBR): The proposed activities must be based on a review of SBR. The proposal must contain an explanation of how the activities will strengthen the quality of mathematics and science instruction and improve student academic achievement. External Evaluation: Each project must have an external evaluation and accountability plan that includes a list of objectives that will be used to measure the impact of the activities. Each project will report annually to the US Department of Education and the New Jersey Department of Education on progress made in meeting the objectives described in the evaluation and accountability plan. See section 1.9 of this Notice of Grant Opportunity for details related to external evaluation requirements. ELIGIBILITY TO APPLY The eligible candidates for Year Three of this continuation grant are five of the Lead Agencies, and their partner local education agencies, that were competitively awarded funding in Year One. Funding is pending certification by the program office that the applicant is making appropriate progress toward successfully completing Year Two activities and is managing their budget appropriately. Applicants must complete and upload the Documentation of Eligibility, which can be found as Attachment D. The following organizations may be included as additional partners: private schools, or a network of schools and a business or a nonprofit or for-profit organization with demonstrated success in improving the effectiveness of mathematics and science teachers. The New Jersey Department of Education will award approximately $3,552,000 in MSP Competitive Grants. A total of five awards may be made. Each award will be funded up to a maximum request of $710,400. Applicants must include the Documentation of Eligibility (Attachment D) for each of the partner LEAs and partner institutions to establish eligibility in this multi-year grant program. Funding for the MSP is contingent on receipt of federal funds. In addition, the Documentation of Collaboration (Attachment A) verifying that the participants have agreed to enter into this partnership must be included in the application. Failure to include and/or provide the Documentation of Eligibility and the Documentation of Collaboration may result in the ineligibility of the applicant. Collaborative partnership means all partners shall participate with the applicant agency in the preparation of the application and in the implementation of the plan contained therein. Both the Documentation of Collaboration and Documentation of Eligibility forms are part of this NGO. Please reference the Discretionary Grant Application for information on responsibilities of the lead agency (HYPERLINK "http://www.nj.gov/njded/grants/discretionary/apps/"http://www.nj.gov/njded/grants/discretionary/). 1.3 FEDERAL COMPLIANCE REQUIREMENTS (DUNS, CCR) In accordance with the Federal Fiscal Accountability Transparency Act (FFATA), all grant recipients must have a valid DUNS number and must also be registered with the Central Contractor Registration (CCR) database. DUNS numbers are issued by Dun and Bradstreet and are available for free to all entities required to register under FFATA. The MSP Grant is 100% funded under Title II Part B of NCLB, P.L. 107-110. APPLICATION SUBMISSION The New Jersey Department of Education operates discretionary grant programs in strict conformance with procedures designed to ensure accountability and integrity in the use of public funds and, therefore, will not accept late applications. The responsibility for a timely submission resides with the applicant. The Application Control Center (ACC) must receive the complete application through the online Electronic Web-Enabled Grant (EWEG) system at HYPERLINK "http://homeroon.state.nj.us/"http://homeroon.state.nj.us/ NO LATER THAN 4:00 P.M. March 9, 2012. Receipt for submission is required; applicants should print a copy of the submission page and email notice once their application is submitted. The reports will be reviewed to ascertain the degree of the grantees progress within the scope of work appropriate to the current agreement period and its conformance with program regulations and enabling legislation. The grantee is expected to complete all of the MSP program requirements and to make satisfactory progress toward the completion of the comprehensive plan. Failure to do so may result in the withdrawal of current and/or continued funding by the New Jersey Department of Education. The project director should submit Year Three APR as a Final Project Report. The Final Report is due November 18, 2013. The NJMSP Program Officer reviews and gives final approval prior to submission to the USED.  1.9 Assessment of Statewide Results Each partnership project shall develop an external evaluation and accountability plan for Year Three activities as well as a cumulative report. MSP Applicants must explain how they will evaluate the success in achieving their measurable objectives. Project directors are encouraged to collaborate with other applicants in securing the services of an external evaluator. Applicants are also encouraged to insure that they meet all GPRA criteria as defined in the Criteria for Classifying Designs of MSP Evaluations. 1.10 Reimbursement Requests Payment of grant funds made through a reimbursement system rather than through scheduled monthly payments. Reimbursement requests for any grant funds the local project has expended are processed through the Electronic Web-Enabled Grant (EWEG) system. Requests may begin once the grantee has received the grant agreement. Grantees must submit requests at least 10 business days before the end of the month, but no later than the 15th of the month in order to receive payment the following month. You may include funds in your request that will be expended through the last calendar day of the month in which you are requesting the reimbursement. If the grantees request is approved by the NJDOE program officer, the grantee should receive payment around the 8th-10th of the following month. NOTE: Payments cannot be processed until the award has been accepted in EWEG. SECTION 2: PROJECT GUIDELINES The intent of this section is to provide the applicant with the framework within which it will plan, design, and develop its proposed project to meet the purpose of this grant program. Before preparing applications, potential applicants are advised to review Section 1.1, Description of the Grant Program, of this NGO to ensure a full understanding of the states vision and purpose for offering the program. Additionally, applicants are to review the information contained in Section 2, which specifies the requirements that are to be considered and/or addressed in the projects. Please note that the passage of the School District Accountability Act (A5 or Chapter Law 53) places additional administrative requirements on the travel of school district personnel. The applicant is urged to be mindful of these requirements as they may impact the ability of school district personnel to participate in activities sponsored by the grant program. When submitting an application, the agency must use the EWEG online application system located at HYPERLINK "http://homeroom.state.nj.us/"http://homeroom.state.nj.us/. 2.1 PROJECT DESIGN CONSIDERATIONS Successful NJMSP grant applicants will propose a one-year project that is consistent with their Three Year Plan described in the Year One application. Projects will provide intensive, sustained and supported professional development for well-defined vertical teams of mathematics and science teachers. 2.2 PROJECT REQUIREMENTS Statement of Need (not to exceed 2,500 characters) The application must include the results of a comprehensive assessment. The statement of need should indicate a clear understanding of results of the needs assessment and how the goals and activities of the program are directly related to those needs. The following items are required to satisfy the needs assessment: Identify specific gaps or weaknesses in the curriculum and in student achievement that will be addressed by the proposed MSP program; Specify professional development needs with respect to the teaching and learning of mathematics and science; and Provide information about how MSP professional development activities will support or enhance each partner LEAs Professional Development Plan for academic year 2012-2013. Project Description Update (not to exceed 2,500 characters) Provide a summary that briefly describes the current state of their project. The update should describe progress toward meeting the goals and completing the activities of Year Two. The update should also report on the status of their Year Two budget, as of the end of the 2nd quarter. Scientifically-Based Research (SBR) (not to exceed 2,500 characters) Justify, citing the literature, why the proposed activities have been selected. Include an explanation of why the activities are expected to improve student academic achievement and to strengthen the quality of mathematics and science instruction. Project Description (not to exceed 5,000 characters) Describe the key activities that will take place during the third year as well as timeframes, resources, responsible persons, and how external evaluation will be accommodated. The narrative must provide a description of the number, type, and duration of the professional development experiences, including the number of teachers engaged. Describe how the partners collaborated to select/develop the MSP program activities, including the types of organizations involved in the process (e.g., STEM faculty, districts, and other potential partners). Explain how the professional development activities align with the New Jersey Professional Standards for Teachers. Provide a brief description of how this project will support or enhance existing professional development activities taking place in the partner LEAs. Goals, Objectives, and Indicators for Year Three (not to exceed 2,500 characters) Identify the measurable indicators that the project will use to measure success in meeting the MSP goals and objectives. The overarching goal of the MSP Grant Program is to improve student academic achievement in the areas of mathematics and science. Goals: As a result of the sustained supported professional development participants will: Identify and clarify core knowledge and skills in mathematics and science that are aligned to the content foci for the program year. The clarifications should include core concepts, specific ideas, practices, level of sophistication, and appropriate technical terms related to a topic at specific grade levels embedded in the Common Core State Standards for Mathematics and the New Jersey Core Curriculum Content Standards for Science. Improve the coherency of the development of mathematical and scientific ideas from grades K to 12. Participants will make effective use of research on student learning to identify potential learning difficulties, developmental considerations, and common misconceptions associated with a science or mathematics topic. Apply effective content-specific pedagogical strategies and teach scientific and mathematical ideas by imbedding them in useful contexts. Develop their ability to make connections within and across mathematics and science topics. Be empowered to continue and expand the work of their professional learning communities once funding is no longer available. Objectives: Participants will Improve the coherency of the of topic development within a grade level as well as the K-12 vertical articulation. Develop greater understandings of the mathematical or scientific content they teach. Increase students content knowledge that is aligned to the content foci for the program year; and Increase student achievement in math and science. Project Activity Plan for Year Three (not to exceed 5,000 characters) MSP professional development activities will promote improved coherency of mathematics and science instruction thereby increasing opportunities for students of all backgrounds to achieve the learning goals articulated in the Common Core State Standards for Mathematics and the NJCCCS for Science. In this section of the application, define the responsibilities of partners and fully account for how all the goals and objectives will be met. Provide definitive timelines for when activities will occur and their duration. Required Activities: Partnerships shall use funds provided for the following activities: Operate mathematics and science summer institutes for a period of not less than 2 weeks (or equivalent to 10 days/70 direct contact hours) and provide follow up support for vertical teams of elementary and secondary school mathematics and science teachers that: Identifies and clarifies core knowledge and skills in mathematics and science. The clarifications should include core concepts, specific ideas, practices, level of sophistication, and appropriate technical terms related to a topic at specific grade levels as specified in the Common Core State Standards for Mathematics and the New Jersey Core Curriculum Content Standards for Science. Improves the coherency of the development of mathematical and scientific ideas from grades K to 12. Conduct school-based professional development activities for a period of not less than 4 days (28 hours of direct contact) during the academic year. These activities may take place on Saturdays or during evening hours as long as they contain equivalent direct contact hours. Establish and support Professional Learning Communities comprised of participant teachers (see: HYPERLINK "http://www.nj.gov/education/profdev/pd/teacher/common.pdf"http://www.nj.gov/education/profdev/pd/teacher/common.pdf). * Create opportunities for enhanced and ongoing professional development of mathematics and science teachers that supports the development and/or implementation of the evidence-based curriculum. Build skills and norms necessary for the expansion and sustainability of the Professional Learning Communities. *Projects must provide at least 110 hours of professional development for each participant teacher annually.Permitted Activities: Partnerships may use funds for the following activities: Training in the development and use of assessment items ; Engage teachers from previous cohorts in the professional development activities: Instruction in how to use data and formative assessments to inform classroom practice; Supplemental and follow-up activities such as distance learning and activities that train teachers to utilize technology in the classroom; Tuition payments on behalf of participating teachers to pursue advanced course work (up to 12 credits annually) in mathematics, engineering, or science; Establish distance-learning programs for mathematics and science teachers using curricula that are innovative, content-based, and built on current, scientifically-based research; or Establish and operate programs that bring mathematics and science teachers into contact with working scientists, mathematicians, and engineers, to expand teachers' knowledge of subject-matter content and research in science and mathematics. What is the impact of the MSP Partnership Program on student achievement in terms of how students of treated teachers compare with statewide and district-wide mean scores for statewide test results? Identification of an external researcher, or research team, who (i) has agreed to carry out the external evaluation, and (ii) who has previous experience in carrying out a high-quality education research. A brief description of the plan for recruiting the required sample of comparison group teachers to participate in the external evaluation. A brief description of how the external evaluation will measure project outcomes. The evaluation should use existing data collection instruments that have already been deemed valid and reliable; or data collection instruments developed specifically for the evaluation are sufficiently pre-tested with subjects who were comparable to the study sample. Description of how the external evaluator will compile and report on the cumulative impact of the three year project. Commitment and Capacity of Partnership (not to exceed 1000 words) Outline a clear process for meeting identified needs and deadlines. Describe a clear process for making collaborative decisions, specific roles and responsibilities for each partner in the program. Describe how the LEA partners plan to continue the professional development activities beyond the three year grant funding. 2.3 BUDGET DESIGN CONSIDERATIONS The MSP program funds must be spent exclusively on costs associated with providing high quality, content-specific professional learning opportunities to math and science teachers of grades K-12. In general, it is expected that MSP project funds will be budgeted at a level of up to $55 per teacher per contact hour. Applicants should refer to pp. 15 and 16 of this Notice of Grant Opportunity to insure that proposed activities are within the scope of the required or permitted activities. 2.4 BUDGET REQUIREMENTS For staff member whose duties include both administrative and instructional services create separate budget entries showing the requested amount for each set of services. Describe the grant-related services to be provided, as well as whether or not the person is working outside regular hours. Be sure to describe each benefit and its percentage when benefits other than FICA are being requested. The provisions of A-5/Chapter Law 53 contain additional requirements concerning prior approvals, as well as expenditures related to travel. It is strongly recommended that the applicant work with their business administrator when constructing the budget. The NJDOE applies the A-5 restrictions uniformly to all grantees. Unless otherwise specified, the following restrictions apply to all grant programs: No reimbursement for in-state overnight travel (meals and/or lodging) No reimbursement for meals on in-state travel Mileage reimbursement is capped at $.31/mile The applicant must provide a direct link for each cost to the goals and objectives in the project Activity Plan. Costs associated with or for non-public teachers and any other non-public cost(s) must be budgeted separately. Be sure to check the Non-public box for those costs. PLEASE NOTE: MSP funds may not be used to pay for nonpublic school substitutes. A maximum of ONE formal round of pre-award revision will be conducted. Grant award amounts will be based on the budget entries that are appropriately qualified and approvable after that one round. General guidance on how to construct the budget and how to construct budget entries are provided in the Discretionary Grants Application document, which is available at: HYPERLINK "http://www.nj.gov/njded/grants/discretionary/apps/dga.pdf"http://www.nj.gov/njded/grants/discretionary/apps/dga.pdf. The NJDOE will disallow all ineligible costs, as well as costs not supported by the Project Activity Plan. These funds will not be eligible for reallocation. Grant funds must be used to supplement and not supplant existing efforts of the organization. Federal funds cannot be used to pay for anything that a grant applicant would normally be required to pay for with either local, state, or federal funds or aid. This requirement also covers services previously provided by a different person or job title. The exceptions are for activities and services that are not currently provided or statutorily required, and for component(s) of a job or activity that represent an expansion or enhancement of normally provided services. MAXIMUM ELIGIBLE COSTS: Project Management Team Salaries These shall not exceed 10% of the grant amount. Upload a current signed memo from the Vice President or equivalent in Human Resources that describes and certifies the regular annual salaries or regular hourly rate of the persons shown. Be sure to budget only those rates. For budget entries that represent administrative costs be sure to check, Administrative, in the Cost section of that budget entry. Higher Education Faculty: All faculty costs must be reasonable and necessary to implement program activities. Department staff will review each budget entry and as appropriate disallow a cost or portion thereof. Additionally, the budget entries must demonstrate clear and specific links to the project activity plan. Upload a current signed memo from the Vice President or equivalent in Human Resources that describes and certifies the cost basis, description of each benefit type and its percentage amount for the persons identified. % Based on OMB Circular A-21, the IHE will need to keep records to identify that these payments reflect the amount of salary and fringe benefits related to the MSP work, calculated "based on the individual faculty member's regular compensation for the continuous period which, under the policy of the institution concerned, constitutes the basis of his salary." (See OMB Circular A-21, Section J.10.d and Section K.10.a.) As with all uses of federal grant funds, the subgrantee will also need to maintain records to document that this payment is reasonable and necessary to the approved project. For budget entry, describe in the Title of Position and Description boxes the position and work responsibilities as well as the cost, its specific need and relation to the grant, and a cost that supports the cost basis shown in the Cost Basis section. For full-time employees working a part of all of their regular work day on the grant, applicants must describe the actual professional development instruction or coaching (instructional salaries) duties to be performed and to whom they are providing the services. All other duties should be coded as non-instructional salaries. Applicants must be sure to include an appropriate cost basis such as the hourly rate and the number of hours worked. For salaries, show the annual salary (if less than 12 months be sure to identify the percentage of time covered by the salary) and the percentage of that salary being paid by the grant. For positions that have a percentage amount shown in the Other Benefits box be sure to list in the Title of Position box each of the Other benefits by name and percentage amount such that the total of the individual Other Benefit percentage amounts equal the percentage amount shown in the Other Benefits box. Consultant and Contracts: Not to exceed $1,000 per full day for professional services. Consultant expenses should be calculated according to the state regulations governing travel and lodging expenses. Grant funds may only be used to fund compensation for outside SEM or ED faculty (who are not faculty member employees of the grantee IHE)that are consistent with the outside faculty members regular, full-time annual salary from their own institution. Verification of the regular, full-time annual compensation rate must be uploaded. Project Management Professional Development: Project Directors and up to one other staff member are required to attend one MSP Regional Meeting that is conducted by the US Department of Education. MSP funds can be used to support travel expenses. Project Directors and key personnel are required to attend one initial state training session and four (4) project director meetings annually. MSP funds should be budgeted for these events. External Evaluation Services: A maximum of 15% of the total award can be used for external evaluation services. Projects are strongly encouraged to collaborate and secure the services of a common vendor. Teachers Compensation: The grant program's maximum allowable contribution to teacher compensation is $2,000 for each participant. The $2,000 includes any mileage reimbursements and/or hospitality services. Tuition: Annual tuition payment (payable to the IHE where the credits will be earned and coded 200-500) for up to 12 undergraduate and/or graduate course credits is permissible if the course and participant meet all four of the following criteria: The course is directly related to the MSP participants professional development plan; The course will lead to the completion of an accredited undergraduate or graduate education program; The participant successfully completes the course with a grade of B or better; and The tuition for a course is not already provided by the LEA. Travel: Travel expense reimbursement is limited to the state-approved rate per mile of $ .31 cents per mile. Other travel arrangements should be made by the least expensive means available. Meals and/or in-state overnight lodging is prohibited. A-5 Travel regulations apply to both project employees and participants. Mileage reimbursement budget entries must describe the relation to the grant of the traveler(s) and the grant-related purpose(s) of the travel, as well as a brief explanation of how the number of miles was calculated. Mileage must be a separate budget entry. When requesting conference travel costs such as airfare, lodging, and meals, create separate entries for each conference. Insert this statement, gsa.gov rates will be used at the time of travel, for all conference travel costs. Be sure to identify the relation of the grant of each traveler. (There should be a corresponding conference registration entry). Be sure to itemize a cost basis on a per person basis per day times the number of days basis for meals, per person times the number of grant staff basis for round-trip coach air or rail fare, lodging. Note that car transportation at a conference is generally not allowed. Materials and Supplies: Funds may be spent on materials and supplies to facilitate the professional learning of teachers, not on classroom instructional materials. Additionally, MSP program funds cannot be spent on equipment (e.g. smart boards, computers, podcast equipment, printers, camcorders, etc.) capital improvements, facilities rental, full salaries of administrative or clerical personnel, and tuition charges and/or university fees (already covered in the higher education partners salary and fringe.) For budget entries: Explain what the amounts in the How Many and Cost per Unit boxes represent for the Supply, Equipment, and Other tabs budget entries. If the amounts in those boxes represent a calculation, describe that calculation in the Description box. Use the Description boxes to describe what the cost is, the need for it, and its relation to the grant program. Restricted Indirect Costs: Restricted Indirect Costs are only allowable with current documentation of a current federally approved indirect cost rate from the applicants cognizant federal agency which must be submitted with the application. Eight percent (8%) is the maximum restricted, indirect cost rate allowed and that 8% of the modified total direct cost for the project (total direct costs minus equipment and subgrants) is the maximum amount of restricted, indirect costs allowed. The Department reserves the right to limit indirect costs. Refer to the Discretionary Grants Application (DGA) document, page 18 Form F, for more information on requesting indirect costs. However, institutions are strongly encouraged to maximize the use of grant funds for direct services. INELIGIBLE COSTS: MSP funds may not be used to pay for nonpublic school substitutes. Costs associated with writing the application; Supporting the research of individual scholars or faculty members; Supporting faculty leave. (The support of release time for faculty to participate in the project is permissible as described under Maximum Eligible Costs); Providing compensation for IHE faculty attending workshops or conferences other than U.S. Department of Education Mathematics and Science Partnership Conferences; Supporting travel to out-of-state professional meetings, unless it is demonstrated that attendance at a meeting will directly and significantly advance a project; Costs that are not directly related to the educational program and that are unsupported by the NGO; Fees or stipends for Praxis exams; A-5 restricted costs; Entertaining; and Expenditures for meals at local professional development workshops and local institute training sessions. Providing Services to Eligible Nonpublic School Students, Teachers, and other Personnel The No Child Left Behind (NCLB) legislation, Section 9501, requires all applicants for certain discretionary grant programs to include and provide services to eligible nonpublic school students and/or teachers. The MSP program is subject to the requirements of Sections 9501-9504 of the No Child Left Behind Act of 2001 regarding the equitable participation of nonpublic school teachers in this grant program (see Project Requirements for further information). Nonpublic School Eligibility Nonpublic school eligibility is based on the location of the nonpublic school(s), the design of the specific grant program and the needs of the nonpublic school(s). The needs must be able to be met via the discretionary grant programs specific program design. ** Generally, the nonpublic school must be located within the communities or geographic boundaries of the applicant agency or partner agency if applicable. According to the parameters of the grant program and available funding, the applicant agency determines the area to be served. **Example: If the design of the grant program is to provide supplemental math instruction for seventh and eighth grade students, then the nonpublic school(s) must serve seventh and eighth grade students who are in need of supplemental math instruction and must be in the geographic area served by participating public schools. Timely and Meaningful Consultation For assistance in identifying all of the nonpublic schools located within its geographic boundaries, the applicant should visit the Departments website at HYPERLINK "http://www.nj.gov/njded/nonpublic"http://www.nj.gov/njded/nonpublic which includes a list of nonpublic schools by locality as well as Frequently Asked Questions (FAQ) with suggestions on how to contact the schools and how to document those contacts. The applicant agency is responsible to identify all appropriate nonpublic schools and to contact the appropriate nonpublic school officials to begin the consultation process. The nonpublic school(s) must be given a genuine opportunity to participate in the grant program. The NCLB legislation requires all applicants to conduct timely and meaningful consultation with the appropriate nonpublic school officials prior to the development of the local projects grant application and prior to any decision being made regarding the design of the local project that could affect the ability of nonpublic school students, teachers and other education personnel to receive benefits. Consultation must continue throughout the implementation and assessment of activities. Listed below are the considerations that must be taken into account by all applicants when assessing the needs of the nonpublic school students and teachers and when determining in consultation with the nonpublic school(s) whether those needs fit the grants program design. Consultation generally must include discussion on such issues as: which children will receive benefits under the project and how their needs will be/have been identified; what services will be provided; how, when, where, and by whom the services will be provided; how the services will be assessed and how the results of the assessment will be used to improve those services; the amount of funds available for services; and how and when decisions about the delivery of services will be made. NOTE: A unilateral offer of services by an applicant agency with no opportunity for discussion on the part of the nonpublic school representative is not adequate consultation. Consistent and Comparable Services and Benefits The NCLB legislation requires that the participation and involvement of the nonpublic school partners and participants be consistent (closely parallel, be similar) with the number of eligible children enrolled in nonpublic elementary and secondary schools within the geographic boundaries of the applicant agency or partner agency if applicable. The grant-related services and benefits must be comparable (having a similar effect) to those provided to public school children and teachers participating in the program, and they must be provided in a timely manner. All services to nonpublic school students and teachers must be secular, neutral, and non-ideological. The Education Department General Administrative Regulations (EDGAR) 76.652 states that the applicant agency shall give appropriate representatives a genuine opportunity to express their views regarding each matter subject to the consultation requirements outlined above. By following this course of action, a successful consultation will result in a well-matched agreement between the applicant and the eligible nonpublic school(s). This agreement should: be appropriate for the specific grant program; allow for the orderly and efficient integration of the services for the nonpublic school students/teachers into the operation of the local project; and result in benefits which have similar effects for both the applicant and the nonpublic school students and/or teachers. Use of Funds Requirements (EDGAR 76.650 - 76.662) When providing benefits to nonpublic school students with federal funds, the following must be addressed: The grantee must maintain administrative control over all funds and property. (No funds can flow directly to the nonpublic school via a subgrant). The grantee may place equipment and supplies in the nonpublic school for the period of time needed for the grant. The grantee must ensure that the materials are used only for the purposes of the grant and can be removed from the nonpublic school without remodeling the nonpublic school facility. Funds cannot be used for construction of nonpublic school facilities. Funds must be used to meet specific needs of students and staff. (Funds cannot supplant benefits normally provided by the nonpublic school). Funds may be used to pay for services of an employee of the nonpublic school if the employee performs the services outside of his or her regular hours and the employees performs the services under the supervision of the grantee. All benefits provided, including equipment and materials, must be secular, neutral and nonideological. (IASA, Sec 14503) ____________________________________________________________________________________ *A nonpublic school is defined in N.J.A.C. 18A:46A-1 as an elementary or secondary school within the State, other than a public school, offering education for grades kindergarten through 12, or any combination of them, wherein any child may legally fulfill compulsory school attendance requirements and which complies with the requirements of Title VI of the Civil Rights Act of 1964 (P.L. 88-352). A list of nonpublic schools by LEA district can be found on the New Jersey Department of Education website at HYPERLINK "http://www.nj.gov/njded/nonpublic/"http://www.nj.gov/njded/nonpublic/. Required Forms The applicant must scan and upload, as part of the EWEG application the signed Nonpublic Equitable Participation Summary and Affirmation of Consultation. Be sure to answer the questions on the form for each nonpublic school. Use an attached page as necessary. This form can be found as Attachment B. An applicant agency may be disqualified from MSP program funding if it fails to provide this form annually.
